S.8 - Executive Orders Act (2025)

Be it enacted by the Senate and House of Representatives of the HelloMiners Congress assembled,

Section 1. Short Title

This Act may be cited as the “Executive Orders Act (2025)”.

Section 2. Purpose

The purpose of this Act is to establish clear limitations, procedures, and oversight mechanisms governing the issuance and enforcement of Executive Orders by the Player President.

Section 3. Scope of Executive Order Power

(a) The President may issue Executive Orders only to:

(i) Direct government agencies in the execution of established laws;
(ii) Manage immediate government emergencies;
(iii) Organize or restructure internal executive functions not in conflict with existing laws.

(b) Executive Orders shall not:

(i) Create new criminal offenses or punishments beyond those established by Congress;
(ii) Impose taxes, fees, or resource quotas without legislative approval;
(iii) Override, repeal, or amend any Act of Congress;
(iv) Interfere with the Justice Department’s ability to carry out the law.
(v) Modify election rules or succession laws.

Section 4. Formal Requirements

(a) An Executive Order must be issued in writing and must include:

(i) A unique Executive Order number;
(ii) A statement of authority citing relevant server laws;
(iii) The specific instructions or actions mandated;
(iv) The effective date.

(b) The President must publish all Executive Orders in the appropriate government discord channel.

Section 5. Congressional Review

(a) Congress may, by simple majority vote, pass a Resolution of Disapproval for any Executive Order.

(b) Upon passage of such resolution, the Executive Order is immediately null and void.

Section 6. Judicial Review

(a) The Supreme Court may review any Executive Order for constitutionality.

(b) Any player may file a challenge alleging that an Executive Order exceeds presidential authority or violates law.

Section 7. Unlawful Executive Acts

(a) Any Executive Order issued in violation of this Act is considered void ab initio (invalid from the start).

(b) Agencies shall not enforce any Executive Order declared invalid by Congress or the Courts.
