A BILL
S.6. Elections Act (2025)
Be it enacted by the Senate and House of Representatives of the HelloMiners Congress assembled,
Section 1. Short Title
This Act may be cited as the “Elections Act (2025)”.
Section 2. Purpose
To establish a uniform system for the election of a President, a Senate, and a House of Representatives; to prescribe qualifications, procedures, and administration of elections; and for other purposes.
Section 3. Regular Elections
(a) Schedule - Regular elections for the President, Senate and House of Representatives shall be held twice each year -
(i) Beginning on the first Monday of June; and
(ii) Beginning on the first Monday of December.
(b) Unified Elections - All elective offices listed in subsection (a) shall be elected during the same Election Period unless otherwise provided by this Act.
(c) Duration - Each Election Period shall last seven (7) days from commencement.
Section 4. Administration of Elections
(a) Duties of the Secretary of State - The Secretary of State shall be responsible for coordinating, supervising and certifying all elections conducted under this Act.
(b) Unvailability - If the Secretary of State is unavailable to perform their duties—
(i) The next Secretary in the established order of succession shall assume responsibility, unless the President or their Cabinet declares otherwise;
(ii) If no Secretary in the order of succession is available, the Senate may appoint a temporary administrator for the election.
(c) Election Officials - Where budgets allow, the Secretary of State may appoint election officials to carry out specific duties related to the conduct of the election.
Section 5. Nominations
(a) Issuance of Nominations - A Nomination Period shall be issued by the Secretary of State for each regular or special election.
(b) Timing - The Nomination Period must begin no less than one (1) week prior to the start of the Election Period.
(c) Eligibility Confirmation - During the Nomination Period, the Secretary of State shall verify that candidates meet the qualifications set forth in this Act.
Section 6. Candidacy and Qualifications
(a) General Eligibility - Any active Player may run for any elective office, subject to the specific qualifications of that office allowed by the constitution.
(b) President - To be eligible for election as President, a Player must have the recorded Server playtime set out in the Constitution.
(c) Senate - To be eligible for election or appointment to the Senate, a Player must possess a plot in the city they seek to represent.
(d) Activity Requirement - All candidates and voters must remain active throughout the Nomination Period and the Election Period. A ban shall be considered inactivity.
(e) Discord Requirement - All candidates must be able to carry out their duties by joining and participating in the relevant Discord servers as required for their office.
Section 7. Multiple Candidacies and Vacating Seats
(a) Multiple Offices - A Player may run for more than one office in the same election.
(b) Assumption of Office - A Player who wins election to multiple offices must choose one (1) office to assume.
(c) Vacating Congressional Seats - Any Player elected or appointed as President or as Supreme Court Justice shall be required to give up their seat in Congress upon assuming that role.
Section 8. Special Elections and Vacancies
(a) Special Elections - A special election may be held to fill any vacant elective office.
(b) Notice - Notice of a Nomination Period must be given prior to any special election.
(c) Senate Seats - Election or appointment for Senate seats shall be managed according to the rules of the city represented, insofar as those rules do not conflict with this Act.
Section 9. Campaign Conduct and Finance
(a) Prohibition on Bribery - No Player may bribe or attempt to bribe another Player at any time during the Nomination or Election Periods.
(b) Campaign Funds - All Players running for office must declare to the Player Government any funds received for their election campaign.
(c) Enforcement - Violations of this section may result in disqualification or other penalties as provided by law.
Section 10. Voting Procedures
(a) Presidential Election:
(i) Majority Requirement - Where more than two (2) candidates are standing for election, a candidate must receive more than fifty percent (50%) of the votes cast to be elected.
(ii) Elimination Rounds - If no candidate receives the required majority, the candidate receiving the fewest votes shall be eliminated, and an additional round of voting shall be conducted. This process shall repeat until one candidate attains the required majority.
(iii) Vice Presidency - The winning candidate’s running mate shall be their Vice President. Where no running mate has been chosen, this shall be awarded to the runner-up.
(b) House and Senate Elections:
(i) House Unopposed Elections - If eleven (11) or fewer candidates are nominated for the House of Representatives, all such candidates shall be declared elected without a vote.
(ii) House Contested Elections - If more than eleven (11) candidates are nominated, an election shall be held using the Borda count method, or such equivalent method as may be defined by the Secretary of State consistent with this Act.
(iii) Senate Contested Elections - If more than one (1) candidate is nominated for a city’s seat, an election shall be held using the Borda count method, or such equivalent method as may be defined by the City represented.
(iv) Certification - The candidates receiving the highest Borda scores shall be declared elected.
Section 11. Certification and Effective Date
(a) Certification - Upon conclusion of the Election Period, the Secretary of State shall certify the results and announce the winners.
(b) Effective Date - This Act shall take effect immediately upon its passage.
